Finally: Agudah Comments on the Potentially Dangerous People Who May Lurk in Our Children's Yeshivas

Just a quick point:

I am so darn sick and tired of the comments and e-mails telling me, in response to this post, that the Agudah has no responsibility whatsoever to issue any sort of comment on the topic of sexual abusers being employed by the very schools the organization claims to represent. Which part exactly do you people take issue with?

Perhaps you feel that the Agudah representatives are making it clear that they do not want to take responsibility for who comes in contact with our children when they are at school. That the Agudah evidently feels it is a decision best left to the administrations of individual schools, and not within the purview of the organization. That this is simply not a topic that they feel they are in a position to address. That they are entitled to maintain silence on a topic they feel is out of their control. Right. Unless, of course, the detrimental people who might possibly come into contact with our precious young children are the absolute worst of the worst, the most base of all people, the disgusting and intolerable spawn of the most perniciously evil people known to mankind. That's right. The children of (cue scary music)...bloggers. A snippet of Gil's report from Thursday night at the Agudah Convention (emphasis mine):
R. Matisyahu Salomon had a generally positive message about strengthening ourselves and our respect for Gedolim, rather than knocking down those who disrespect them. He specifically said that we do not have a ta'anah (complaint) against those who ask questions with derekh eretz (respect). However, he did have a few lines that were somewhat startling. He referred to (disrespectful) blogging as a disease that is contagious and he said that the children of such people are a danger in our schools.
Yeah. the children of bloggers are a danger in our schools. But something as innocuous as a child molester - that is simply not a subject the Agudah will deign to comment on.

Makes sense.

I guess that's why so many bloggers choose to remain anonymous, so that their children would not be regarded as spreading the disease. They can adapt the guidelines for fever: Child must remain out of school at least until 24 hours after his/her parent has shut down the pernicious blog and retracted anything that may be construed as disrespectful.

Frankly, I agree that disrespectful blogging -- particularly when the blogger or blog commenter is anonymous -- is like a dangerous contagious disease. All Jews need to be civil with each other even while disagreeing. The level of invective on blogs is one reason why I don't post much any more.

Charlie. Do you think that we should hear more chest-beating from the Agudah reps about protecting our children from blogger's children than we hear about protecting them from child molesters? I think the latter. Or at least let's give them equal billing. They didn't list one session at the recent Agudah convention that dealt with keeping our children safe from predators.

I have never heard one iota of advice from anyone but my non-Orthodox pediatrician about how to speak to my children about how to avoid or report abuse. Shouldn't this be something we hear about from our community leaders? Don't you think this shows a woeful level of denial in light of recent allegations? Trust me, there are more cases of child molesters discovered to be preying on young kids in our community than ever come to public light. I shudder to think of the cases (according to research, the vast majority) that actually go unreported.

the agudah wants to prevent the charedi community from thinking for themselves. they want us to trust that they are prtecting our children for us and not ask any questions. yet they are not protecting our children adequately. i can tell you now that i am a part-time learning rebbe in brooklyn. no one has ever set out guidelines for me to ensure the boys i learn with have safety. no one has ever told these parents not to leave me alone in the house with thier sons. i take some boys home from school in my car daily. obviously i am not a molester. but i shudder to think that there could be one out there who having the same opportunities with young boys that i am freely given by their trusting parents. yes, these parents trust me because i am trustwoirthy and responsible. but they just need one guy who puts up a front of being trustworthy and is actually a pedophile.

a few years ago there was a story about a piano teacher who was molesting hundreds of his students for years. the parents completely trusted him. no one thought to set guidelines to protect their children.

I am pleased to say that my children, who attend/ed a frum yeshiva in Queens, had an in depth discussion (as early as kindergarten) about good/bad touch, what is appropriate and what isn't, what to do if they're uncomfortable, etc. I, as a parent, have broached the topic myself but I'm sure that this lesson in school was a welcome opening for other parents who may not have been as comfortable to discuss the topic at home.

The Agudah doesn't mention a lot of important issues at its conventions. Some issues are actually a lot more prevalent (and as dangerous) as sexual predators.

As you once posted, there is a lot going on in our schools that harm our children: the prevalence of bullies in our schools, the recent trend towards schools to reject children based on their parents' professions (which is on the same path as this blogger issue), the elitism that schools employ to reject children with special needs, and the lack of valid teaching credentials to teach our students.

Just to name a few. I understand that Kolko is in the news now, but seriously. There's a lot that needs to be said, and the fact that everyone is not rushing to a podium to comment on the fact that Kolko has finally been arrested doesn't bother me as much as it does the blogging world.

What is being said at these conferences do bother me, because they create more problems that will plague the Jewish world down the road.

OM's referel to a Rav with a "R'" is standard etiquette for rabbanim -- where a R. stands for Rav. Once you get started with Moreinu, Rabbeinu HaRav HaGaon and adding on Shlita it just makes keeping track of everyone's title more difficult (and someone will always get insulted).

I don't think for a second that OM was trying to take away from Rabbi Matisyahu Solomon's stature.

I noticed a strange thing:

Search the NY sex offender Websites in Kings (Brooklyn) and Rockland counties. I couldn't find a single "Heimisher" sex offender with Brooklyn. In Rockland, there were quite a few. This makes absolutely no sense statistically -- there are a lot more frum Jews in Brooklyn than Rockland. Maybe the DA in Rockland is more serious than the one in Brooklyn?

Though I'm certain there is quite a number of abuse cases that go unreported or unpunished, one frum sex offender on record in a neighorhood of thouands of frum Jews is very encouraging.

I usually agree -- or at least don't seriously disagree -- with OM's analysis. But this time I'm not on board.

First, while Rabbi Shafran's original "not my job, man" comment was not his finest hour, it is irresponsible to expect Agudah to say *anything* when a current criminal case is pending. A defense attorney could potentially use such statements to significantly alter the outcome of the case.

Would anyone be happier if Agudah or Torah U'Mesorah said, "We are against the molestation of children" or some equally parve equivalent? I doubt it; the complaint would then be that Agudah wasn't being proactive enough.

Anonymous at 12:20 was correct to mention bullying: this is a far more widespread problem, and from a clinical viewpoint, often just as damaging as sexual molestation. Yet I don't read many posts calling bullies or their parents "monsters".

Why? Possibly because most of us feel more secure that we are not child molesters than that none of our children engage in bullying. Or perhaps we're not as aesthetically disgusted by bullying as by sexual abuse of children. Bullying is not as, well, "icky" to us.

And that's what disgusts me most. The more strident someone is about *one* form of abusive relationship without discussing its far more common cousin, the more I believe that his/her chest-beating is merely about making themselves feel righteous, *not* about caring for children.

When someone is serious about the abuse of children, he/she will be no less disgusted by the bully and his/her parents and enablers than by the sexual predator. One's commitment to defending the weak should not be determined by what one finds personally most repellant, but by what defense is actually needed.

So, yes, Agudah should be against sexual abuse, physical abuse, and psychological abuse in all their forms. Not just the ones that give people the creeps!

The chairman of the evening at the Agudah Convention was Dr. Dovid (Dudie) Diamond a very well respected pediatrician who's FatherA'H was Dr. Isaac Diamond an obsetrician and a legend who delivered and treated thousands of yiddishe kindrlach.

I wonder what Dr, Diamond's position is on "sweeping it under the carpet"

I agree. I have posted on bullying and I think it is a huge problem with the potential to seriously harm the psyches of scores of young children. I think our leadership have a responsibility to address the importance of middos and make teachers and rebbeim aware of how prominent their role should be in preventing bullying and the mental torture that goes on among schoolchildren.

I am only discussing the issue of molestation right now because of its recent publicity.

The first thing to understand is that Agudah is in a lose lose situation. If they take responsibility for the Kolko problems, the blogs will bash them. If they dont take responsibility they will be bashed for lying and covering up.

Agudah does not have to comment just because the bloggers and those who read them think they should. Personally I feel that the Agudah should say that bottomline the children should have been protected, and there was a terrible failure. But will every blogger be happy with that.

There is no win for them, and since you know the Agudah and the Moetzes position on blogging, their main consistuency is not the people on the blogs. Even tho R' Gil Student has a terrific blog site, even he is not who the Agudah is catering to.

If you read these blogs you fall in to the trap that every Rav is a greedy terrorist, that every school has a molestor problem, and that this is a huge problem for our kids. There is no doubt in my mind that there were many many Kolko victims, there is no doubt that the administration was far worse than even Kolko for allowing him to continue there, and I believe that the school should be closed down, and anyone sending to that school is insane. But even in that school, a small percentage were victims. By the publicity generated, there is no way that a parent today, would let a Rabbi get away with anything. It is now a different time. There may be incidents in the future, but I dont think its reasonable to think that our children are in huge danger.

Okay -- Let's demonstrate how much appalled we are by ... by ... by ... demanding that something be done by somebody, somewhere. And saying so!

1. True, I am definitely comparing apples and tomatoes -- they are both fruit. They have differences, but they also have similarities.

2. Bullying is most *definitely* a breach of trust and a misuse of position. It is a breach of trust on the part of adults who are supposed to keep children safe to the best of their abilities. It is a misuse of power by adults who *could* prevent it, but don't take it seriously, as well as by parents who are unable or unwilling to prevent bullying by their own children.

3. Dismissing a specific point by saying that the individual lacks understanding or suggesting that the person wouldn't *want* to hear an alternative viewpoint begs the question. I'm not sure why my use of "icky" to describe our feelings about molestation is inappropriate. You *don't* find it icky? I thought we were all at least able to agree on that.

My point is this: whatever form abuse takes, it has long-lasting effects on children. The degree of trauma depends of many factors, which may include the type of abuse, the abuser's relationship to the victim, the length of time the abuse continues, the presence of loving relationships in the child's life, and the child's own natural resilience.

As mental health professionals who work clinically with such children will confirm, each child experiences abuse differently -- some are devastated, some recover with help, and some are resilient enough to cope on their own. There is no way to discuss in the abstract what circumstances are "worse" than others.

To focus so much outrage -- note that I say "outrage" rather than action -- on one type of abuse at the expense of all others means that we want to impose *our* hierarchy of disgust rather than truly reduce the number of children abused and the severity of that abuse.

It is true that OM and others have discussed bullying, but the responses run toward, "Oh, yeah, that's really bad. Kids shouldn't do that" rather than "What monsters". And we hardly hear a word about physical abuse, though I just spoke several days ago with a principal at a prominent day school who has a list of students whose grades must always be altered before report cards are sent -- lest they come to school the next day with bruises.

Abuse is bad, period! And for any of us to assume that *we* have inside information about what's worst, bad, or not-so-bad shows, at best, inadequate information about the nature of abuse in all its forms. Even personal experience of abuse does not give us authority to speak for another. Another individual in the same circumstances may have suffered more or less than ourselves.

That said, it's hard to argue that either as parents, educators, or as a community, we couldn't stand to improve the way we address the types of abuse that, unfortunately, our children must endure.

I don't believe that the Agudah has to be in a lose-lose situation. The fact that they are seems to be of their own doing. But, if they were to do more than to come out and condemn abuse, but rather make up for lost time by leading all of the Orthodox umbrella organizations in creating a system to deal with those in our system who are predators, I'd say they would look pretty positive.

I don't know that chest-beating is in order, but I agree that Orthodox organizations need to be proactive in creating a system to deal with potential abuse. Agudath Israel would be in a position to help in this in a way that the OU or NCYI would not be. I hope that it takes up the cause.

Regarding blogs, I obviously don't think they should be banned. But frankly, much of current blog activity is conducive to the development of bad midot and the fostering of divisions among Jews.

But I fear that the blog world is just a reflection of the state of klal Yisrael today. The laws of lashan hara seem to have been repealed. (Especially if the topic of conversation is kashrut.)

I read blogs and I certainly DON'T think that. But if your own child is targeted by an abuser, there is no bigger problem on the planet for you. The priorities just seem a bit skewed when we worry about Gay Rights marches or whatever the Conservative movement decided to do or whether a few Reform "converts" decide they want to live in Eretz Yisrael when we have no way of dealing with abuse situations when they happen (which I hope isn't that often).

It is unfortunate (scary?) that the same people who consider the Agudah one of the most, if not the most, significant organization are the same ones who feel the organization has no reponsibility to take a leading role in the matter of sexual abuse. It shocks and saddens me to no end.

Having said that, I don't think R. Salomon is necessarily wrong (not that i think it ought to be nearly as high on the priority list as child molestation) in terms of the problem with blogging such as this (yes, that makes me a hypocrite to a degree).

If I ask myself, "what does this blog generally, or this post specifically, accomplish?" I see it lets people ridicule the leadership and not much else. What do you feel this post accomplishes? Do you see ANY drawbacks to such a post?

Im far from a supporter of the Agudah, but wasnt there a big issue a few years ago over at NCSY. Now why didnt they create a system? Why didnt they have a team of experts years ago?

Its very easy to spend their money. Do you have any idea what the cost would be to hire the team of experts and create the system? Why should the Agudah be the one orginazation that needs a system? If it will save lives, significantly prevent abuse you have to do it. But I think parents are educated enough now, and schools should be significantly scared enough now, that one could assume that things are different.

Now about Agudah putting our a PR release. Do they have to speak up when the court case starts, when Kolko gets sentenced, when he goes to jail? I believe they have commented on this before, and there was a discussion at their convention for those who wanted to attend. Id like to hear from them on this issue. But from a public relations point of view, perhaps a PR firm would advise them that whatever they say, every word will be examined by every bozo with a blog, so what is the point.

Are you kidding? After the Lanner episode broke, the OU and NCSy did just about everything to redress their wrongs. They hired an outside company to run an exhaustive investigation into how the abuse could have been ignored for so many years. They created a detailed and systematic system of guidelines to prevent future abuse, and they even fired people that were felt to have been inactive in the face of allegations.

Now, what were you saying about NCSY?

So if theres such a terrific program in place, why does the jewish community need another one. NCSY didnt end child abuse in the jewish community because of their investigation. Kolko and Margo are not employees of the Agudah. There were many mistakes made for many years by many people. If anyone has a child that may have been abused, they should probably email UOJ and the lawyers involved. What do you want the Agudah to do. Come up with a scathing report about what a 90 year old man wearing 100 pairs of tzitzos may have said 25 years ago? There are so many bloggers who are obsessed with this issue. Mayve someone can start an orginazation, have a dinner, and a Chinese Auction, and spend $1 million a year on reports and systems to stop this issue. Id rather see the Agudah spend money on drug programs for at risk children and ways to lower tuition. This is not an Agudah only issue and its not the only issue they face. I dont believe its the biggest issue out there.

Because th agudah and NCSY are two different organizations with completely different constituencies? also it has to be taken into account that teh agudah puts much stock in leading their constituents in such a way that they wont make their own decisions. the conceps of daas torah figures heavily into that. whereas NCSY and the OU dont have that expectation. so one could argue that the agudah has even a bigger responsibilty to protect children because they are asking for people to trust them completely on every topic.

Agudah does not control the 100s of Orthodox schools in this country. To be responsible for policies and systems at all these schools is probably beyond the scope of the Agudah from a logistic and financial perspective. NCSY is not comparable. I believe Rav Salomon said he has a professionals number on his phone to contact. I think that shows that things have begun to change. The best prevention is to be alert and aware. These are different times, because we have seen what could happen.

If Orthomom has such a strong opinion, maybe she should draft a letter of what she thinks the Agudahs statement should say, and we can decide if it makes sense.

The truth is, I think the Agudah should make a statement. I think they should deal with the fact that 1000s of jews saw their first grade Rebbe in handcuffs. But I dont feel its correct for Blogs such as this, to offer one side of the story and damage an orginazation that does work for our benefit. Are there people here who occasionally send them a check and now will stop. Do they have to defend themselves on every accusation of anyone who wants to comment anonymously.

it seems that most of us jews simply put our heads in the sand where abuse is concerned.. is it because we were trained tto believe our ravs can do no wrong?? are we that stupid?? from what i have seen in our small community, many of us would rather follow our rabbinic leaders, right or wrong-legal or illegal, no matter what we supposedly intelligent jews think. if your child complains of being "touched" and yu discuss this with one of the rabbonim and the rav says "look away" are you dumb enough to listen??? from what i have read on orthomom blogs--most of y ou would sooner put your bindfaith in your rav than listen to your child... how sad for your children.

I dont see where you came up with this theory. That may have happened years ago. I dont think any sane parent would have any blind faith if their children were concerned.

I highly doubt it. There are plenty of parents that believe the whole thing is a witch hunt. And how many of us interview the heads of each school about their policies in hiring and reporting, instead of just being interviewed ourselves.

A. I'm not at all convinced that there is such a terrific program in place.

B. This is not an MO vs. Black Hat issue. It is an issue that should concern both communities jointly, as there is plenty of crossover between schools. And the solution should come jointly. I know MO people working in RW schools and RW people working in MO schools. And for that matter, I know MO and RW people working in community schools and Solomon Schechter schools, so really the interest should extend even beyond the Ortho community.

Are there people here who occasionally send them a check and now will stop.

I keep my tzedakah local for the most part. But if pro-active action was taken, I'd be happy to send a check.

We need to put pressure where it belongs, not so much with the Aguda, who can do little to effectively protect our children moving forward, but with our legislators that have unfortunately, not kept up to date when it comes to protecting the private school children.

1. Private Schools do not have MANDATORY fingerprinting and background checks for all prospective and existing employees. In fact, private schools until recently COULD NOT fingerprint their employees. The current law puts it in the discretion of the schools. Of course, these mandatory background check laws exist in the public schools.

2. Private Schools do not have an expanded Office of Nonpublic School Discipline within the State Education Department. Under current law, a child (or parent) who has been physically or sexually assaulted or abused by an uncertified teacher (who is permitted to work in nonpublic schools) has no independent forum to hear his claim. The disciplinary panel should consist of clergy, attorneys, and health care and other professionals. I have heard of two individuals who claimed sexual abuse against a Rebbe. The Yeshiva ignored the demands for beis din. The Education Department said that if the rabbi happened to be a certified teacher, they could open a disciplinary hearing. He was not certified and nothing could be done. This is unconscionable.

3. Private Schools do not have a registry of nonpublic school employees who, after hearing, have been found guilty of physical or sexual abuse. Numerous people have asked the yeshivas/day schools to form a disciplinary system and registry that would bar abusive employees from our schools. Nonpublic school employees, credibly accused of abuse, have been found to simply change jobs by moving to another nonpublic school.

4. Private Schools do not have mandatory reporting. If a child or parent tells a public school employee that he has been abused by a teacher or other employee, the school official is required to inform law enforcement authorities. Nonpublic schools should have the same law. This law would prevent predators from moving from school to school.

5. Charter Schools have their own separate section within the State Education Law, setting out their legal requirements. The laws relating to nonpublic schools are scattered throughout the Education Law, often without any logic. We need our own section of the law, so that everyone in the nonpublic school community can have a single section of the law to turn to, read, understand, and comply with. Right now, there's a lot of confusion as to what the law is, and the disorganization of the law is one reason why these laws have not been updated to reflect reality.

It is up to parents to push for these laws to give the schools (and the parents) the tools to keep our children safe.
